AquaLux Remodeling LLC operates as a platform that connects homeowners with licensed independent bathroom remodeling contractors in the greater Los Angeles area. We provide information about bathroom renovation services, allow you to submit inquiry forms, facilitate introductions to local contractors, and may provide scheduling and project management coordination.
We are not a general contractor in all contexts in which we facilitate contractor introductions. When we connect you with independent contractors, those contractors operate independently of AquaLux Remodeling LLC. The quality, timeliness, and outcome of work performed by referred independent contractors is the responsibility of those contractors. It is your responsibility as the homeowner to verify that any hired contractor furnishes the necessary license and insurance required for the work being performed.
However, when AquaLux Remodeling directly employs or supervises workers under a direct contract with you, we maintain full liability for workmanship quality as described in your written service agreement.
You must be at least 18 years of age to use our website or engage our services. By using the Site, you represent that you are of legal age and have the legal capacity to enter into binding agreements. If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information when registering an account or submitting a service request. You must promptly update any information that changes. AquaLux Remodeling reserves the right to suspend or terminate accounts that contain false information or that violate these Terms.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use of the Site. Prohibited uses include but are not limited to:
The Site and all of its content, features, and functionality — including but not limited to text, graphics, logos, images, photographs, video, audio, software, and the selection and arrangement thereof — are owned by AquaLux Remodeling LLC or its content suppliers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, transmit, or commercially exploit any of the material on our Site without our prior written permission.
The AquaLux Remodeling name, logo, and all related product and service names, design marks, and slogans are trademarks of AquaLux Remodeling LLC. You may not use these marks without our prior written permission.
This site is a free service to assist homeowners in connecting with local service providers. All contractors and service providers referred through this platform are independent and AquaLux Remodeling LLC does not warrant or guarantee any work performed by independent contractors. It is the responsibility of the homeowner to verify that the hired contractor furnishes the necessary license and insurance required for the work being performed. We recommend requesting proof of CSLB licensing and current insurance certificates before commencing any work.
We screen and vet contractors in our network as a courtesy to our users; however, this screening does not constitute a guarantee of the contractor's performance, quality, or compliance with applicable laws. You should independently verify a contractor's credentials before entering into any agreement with them.
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. AQUALUX REMODELING LLC DOES NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE INFORMATION ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.
Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In such states, implied warranties are limited to the duration of the applicable express warranty or the minimum period permitted by law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AQUALUX REMODELING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) $100.00 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless AquaLux Remodeling LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any claim that information you provided caused damage to a third party.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
WAIVER OF CLASS ACTION: YOU AND AQUALUX REMODELING LLC AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting to the Site, with the "Last Updated" date revised accordingly. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms regularly. If a change is material, we will provide reasonable notice prior to the change taking effect.
We may terminate or suspend your access to all or part of the Site at any time, with or without cause and with or without notice, effective immediately. Upon termination, your right to use the Site ceases immediately. All provisions of these Terms that by their nature should survive termination — including intellectual property, warranty disclaimers, indemnity, and limitations of liability — shall survive.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AquaLux Remodeling LLC with respect to your use of the Site, superseding any prior agreements between you and us. If any provision of these Terms is found to be invalid, the remaining provisions will remain in full force and effect.
